OUR WASTED INVESTMENT

We went with Tav Pools for our inground. I had concerns of water during the dig and mentioned to the foreman is it normal water came through the concrete pool wall- he said yes hydraulic cement will fix that. I month later water behind the liner and numerous visits and calls to Tav pools. They came out twice then advised me to learn how to drain the liner myself- the home owner- how about a solution why and how to fix. The concrete finish was poorly done in my opinion and water had continued all summer. After the harsh winter now the concrete has cracked. The answer from the pool company is its my backyard and I have a running river under my "subdivision house" They offered to install concrete at their cost- no warranty. The owner said read the back of my contract and clearly stated he challenged me to take this further. I am now stuck with repairing all at my own expense and am dealing with a more professional established pool company.

This customers pool install was no different from any other pool install. It is normal to have a small amount of under ground water seeping through the wet concrete and later it gets plugged with hydraulic cement. One month after the install, they had problems with liner floating. After fully investigating the problem and draining the water from behind the liner three times, we did show the customer how to do this themselves and explained to them that it was a result of under ground water. At this time (July 2014) we advised the customer to install a dry well to help remove all the under ground water from his backyard, but he chose not to. Instead he installed some drain pipe to remove surface water when he clearly knew the problem was under ground water. While working with the customer to come up with a solution to the under ground water, they did install a dry well April 17/15. There were no complaints of poor workmanship with the concrete from the customer at all last year until pictures of the cracks this month (April 2015). At this time we told them that we would redo the concrete after the under ground water issue had been fixed. Every effort was made to appease this problem even though it was not caused by faulty workmanship or faulty material but instead from a heavy flow of under ground water. At this time the customer started threatening us with legal action if we didn't fix everything in his yard at our expense. We made every effort to help and be co-operative until the customers demands became unreasonable. The customers greed of wanting us to pay for his damage caused by his under ground running water has forced us to stop with our willingness to help. We will not be bullied or brow-beaten into cloudy judgement between right from wrong. We welcome any potential customers to drop by the store and view open files and videos of this under ground water problem that occurred long after we built the pool. Please don't let this frighten you from any future considerations of getting a pool as this backyard has an unusually high volume of under ground water flowing, and we feel that there is something out of the ordinary going on in this area. In the video, you can watch the water gushing into the dry well at an alarming speed. One dry well situated in this backyard is clearly not enough to control the under ground water issue.
