In 2013 we 2 skydiving groupons (for $149 each with expiry dates of July 4, 2013) our jumps were scheduled for June 16, 2013. On June 16 signed the waver, paid for our extra altitude, and taxes then waited for the weather to cooperate. After 4 hours we were told to go home as there would be no skydiving that day. I was concerned about leaving without jumping and having paid; I was reassured by staff that everything would be fine and that we would have a year to rebook and if anything it would make things easier because we could skip the paperwork next time.
We rescheduled for June of the following year. On our jump date we received a phone call from the staff warning us that our flight may be delayed due to weather. At the time of the call we were 1/4 way there (a total of a 2 hour one way drive) we explained the long drive to the staff on the phone and with the actual likelihood of the jump considered it was decided that our best option was to rebook, we then rebooked for August. Several days before the flight we experienced a death in the family. I called and explained the situation to the staff, also that our wedding was scheduled for September and that we would not be back from our honeymoon until just before the end of the season. We were told that we would again be given the opportunity to rebook the following year.
In May of 2015 I called and explained I was now 7 months pregnant and was not going to be able to skydive and that after 3 years of trying to make it work we would rather just have our money back. I was informed that they don’t do refunds however the services were transferable. When I found a buyer I called back and put the jumps under the new owner’s names and confirmed that, that phone call was all that had to be done.
I then sold our jumps to our neighbor for the price of the original groupons plus what we paid for extra altitude and taxes, with the understanding that all that had to be done was they go in, watch a video, sign a waiver and jump.
It was not the groupon being transferred from me to them as technically the groupon was redeemed in 2013 (this was confirmed by groupon) , when we were sent home due to bad weather- it was the jump itself being transferred.
The new owners were made to pay extra and the vouchers were used at only the cash value and they did not honour the extended deadline that was promised. when trying to rebook in 2014/2015 it was not mentioned by staff that any additional additional fees would be applied, there website also states that "all deposits and prepays are non-refundable but can be rescheduled or transferred to another jumper. If you are unable to reschedule we encourage you to book only using the deposit option. The booking policy is in place to ensure serious bookings and to secure your spot." With no mention of additional fees being applied.
I again tried to explain that we had tried on several occasions to complete the jumps and it was forces of Mother Nature causing us to be delayed, and we should not be penalized by having to pay more for forces that were beyond our control. She then tried to explain (again, quite rudely may I add) that we were paying more due to the expiry, I again explained that the groupons had been extended by the staff there.
If this is true and we the original jumpers would have been made to pay more, we should have at the very least been informed of any sort of penalty or price increases at each time of rebooking (or listed in the terms of the groupons) and made the offer to ether pay more and jump, or be given the chance to back out of the deal by being offered a refund for the price of our groupon, as raising the price would have then been changing the terms of the original agreement. upon speaking to the owner I was met with belligerence and he kept repeating over and over again that he now thought the problem was that they were TOO understanding and TOO leaneant. He also would not honor the word of his staff that I received in previous years and just said repeatedly "my staff wouldn't have said that.
