This is too bad - Winnipeg needs more good, independent retailers. Not more giant big box stores. Hope customers got their money back on credit cards.

Winnipeg, April 29, 2009 – On April 29, 2009, by Order of the Manitoba Court of Queen’s Bench, Deloitte & Touche Inc. was appointed Trustee of the Estate of NEFCO Furniture Ltd., in Bankruptcy.

The first meeting of creditors of NEFCO will be held on June 4, 2009 at 10:00 a.m. at the Conference Centre, Main Floor, 360 Main Street, Winnipeg MB. To be entitled to vote at the meeting, a creditor must lodge with the trustee, before the meeting, a proof of claim and, where necessary, a proxy.

As there are secured creditors totaling approximately $4.4 million, it is unlikely that there will be funds available for distribution to unsecured creditors.

EMPLOYEES

Employee creditors will receive a separate mailing from the Trustee within the next 45 days, advising of the eligibility to make a claim for unpaid severance and termination pay under the federal Wage Earner Protection Program.

INTERIM RECEIVERSHIP

Winnipeg, December 15, 2008 – On December 15, 2008, by Order of the Manitoba Court of Queen’s Bench, Deloitte & Touche Inc. was appointed Interim Receiver (the “Receiver”) of the assets, undertakings and properties of Nefco Furniture Ltd. (“Nefco”). Nefco had operated furniture stores in Winnipeg and Calgary under the Penthouse, Thomasville, Leather Express and Furniture Galleria names.

The Receiver has contacted all customers where the specific goods were appropriated to the customer and had been paid for in full. All other customer transactions where only a deposit was made, or where the furniture was not specifically appropriated, were not completed by the Receiver; the claims of these customers rank as unsecured creditors of NEFCO.

On March 4, 2009, by Order of the Manitoba Court of Queen’s Bench, the Receiver sold the remaining NEFCO inventory to Davidson’s Furniture Galleries Ltd. O/A La-Z-Boy Furniture. There will not be sufficient funds to satisfy the claims of the secured creditors and accordingly it is unlikely that there will be funds available for distribution to unsecured creditors.

Quick update on this situation - I read the post below and apparently it is not true. I had it checked out to see if there was validity to this rumour. The former owners of NEFCO / Penthouse et al have no ownership interest in this new store.

The owners are just two ex-employees trying to start up a new business.

This is simply not true. The former owners of Penthouse / NEFCO have nothing to do with this new store. I appreciate that people were angry about the bankruptcy, but that is no reason to spread lies and rumours that could affect people.

For years customers have done whatever they could to take advantage of companies by lying, manipulating and playing games. Now that Nefco screwed them over they are crying robbery.

My sympathy does not go out to you as in fact I am laughing at you people who were stupid enough to buy furniture thinking you'd actually get 50-80% off customer orders...

NEFCO and Penthouse Furniture.
The greed and sloppy mismanagement finally caused by the 3rd generation.This is not a surprise at all but still a shock to the employees in many cases out many months earnings ,the vendors as well as clients screwed.
Many clients paid by charge cards so most have fought to get their money refunded.
The irony is that the family running the stores carefully calculated this so receivership verses a bankruptcy = so it pays down vendors then them and not the employees or customers.This group of selfish uncaring people lined their pockets with no regard for their clients or hard working staff.
They had their habits to keep up.
Many bills were not entered the last few weeks so we all know where the money went.
Unscrupulous business practices and word of caution....they will be back in a couple of months under the guise of a new name and fronting the money for a new venture.

I am a 19 year old girl who saved up all her money for a year to buy furniture. I had always wanted to buy from Penthouse and had finally had enough money to do so. I went down Dec. 4/08 after hearing ads on the radio of a huge sale. I went down a bought a bedroom set and a dining room set for an approximate price of $4000. I patiently awaited delivery which they said would be the next day. When it did not come i phoned there and got an answering machine saying that they were behind schedule but assured me it would be coming soon. It is now Jan. 7/09 with no furnitre.

When i thought the furniture was coming i got rid of my old stuff, making room for the new and have been sleeping on teh floor ever since.

I cant believe the management could get away with this!!

Deloitte, the company taking over has been no help and keeps stalling. They oringinally told me the furniture would be coming early January (which it right now) but after calling them yesturday i was rudly told that i would have to wait atleast another two weeks. MOre stall tatics!!!

I just want what i paid for!! Is that too much to Ask???

i purchased a sofa and loveseat from leather express waited 3months did get my furniture or hear back from them they kept saying it was a delay at palliser which was untrue .i got my money back took my receipt to furniture villa on st james street they matched the price ordered in my palliser sofa and loveseat got in 3 weeks excellent service from the salespeople as well as the delivery guys were great i would strongly recommend them to anyone looking for quality furniture , or they can order in most palliser pcs if they do not have it on the floor.

I bought and paid in full for a sofa/chair set and was told that "no problem" we can store this for you until you move to your new condo. Ya right!! So at this point I sit here in Wpg, not knowing whether we can go for our month vacation, should we purchase another set, will I get my money back from Mastercard?? The owners should be ashamed for going "mute" and not at least giving some sort of apologly for whatever it would be worth. Louise

We also bought a bedroom set for $2, 500 at the Penthouse closing out sale on Dec 5.

We previously had a very good experience with them. A few years ago we ordered a large bedroom set from them on sale. A few pieces had defects when it was delivered. However, they reasonably promptly replaced them without argument.

So, I was not really worried about anything going awry with this purchase. Well, when our order did not show up yesterday I knew something had gone awry.

I talked to our credit card company. From what they said things look good for people who bought with credit cards. The representative said that in this case it was the seller's onus to prove they provided the product or refunded the money. If not, the credit card company would charge back against the sellers account. If the account had no money it would simply go negative. The seller's bank would be left "holding the bag" on that one- so to speak. They asked me to fax in one of the news stories about Nefco going into receivership below to start the chargeback process. I'd highly recommend that anyone who purchased on credit card do this asap.

It does seem like the receiver is trying to work out who purchased and should get what inventory. So, hopefully, it will not end up as a disaster for everyone.

The lesson to be learned here seems to be: In this economy, if you are taking advantage of a closing sale, to buy with a credit card. Better yet, as CherryB123 below said: Don't wait for delivery arrange to take the product right away yourself.

Apparently Larry Adelman is back in Winnipeg and working as a veterinarian at a Pembina clinic. Back to his old job. Maybe he could start paying everybody back that Nefco owes money to. LOL.

Right on! Don't know who you are but you have summed up things as they are (were)! This fiasco has been coming for over a year. It is completly due to greedy mismanagement by overpaid and incompetent owners and senior Management who thought they were Masters of the Universe. I know former sales employees who are just sick about thier customers being left without thier furniture or thier money.

We all need to get together and fight these people! We put a down payment of over $3000.00 toward a bedroom suite that was special ordered from Thomasville on Aug.30,2008. They have our money and we have no furniture! Lea Williams-Doherty from CTV news in Calgary is doing a story on this tonight at 6 pm.

I am curious to know how the managers, supervisors and sales people knowing the situation of Thomasville "Fine" Furniture (Blackfoot trail and Glaenmore, Calgary) could carry on business selling to people, and manipulating people, knowing they would not be recieving the goods they purchased and paid for in good faith or repairs to same. How "truly Canadian". I for one would like all of the names of the managers and sales people active at the store at that time, including a Ms. LYN STRINECY (who delayed a repair issue on my purchase of their "Fine" furniture to the point I am on the hook for the cost of damages created by their "Fine" Furniture employees), to have thier names published. These were in fact fraudulent actions against the public. Do they really deserve another job opportunity or even to show their face in another work environment - where has respect, truth, honesty gone? You can tell me the business is business - but I ask you where is the trust and integrity gone?

The staff did not know. We were locked out without warning. We do not get paid until the furniture gets delivered. We're out tens of thousands of dollars for all the items we sold in the past few months that will never be delivered. We also did not get paid commissions for any of the deliveries that happened in November and during the December sale. We busted out butts, we kept calm and dealt with our customers as best we could while the owner hid in his office. Now we are all scrambling to find a way to make our next mortgage payment. Many of us have worked there for over 10 years and can't believe that we've been kicked to the curb. I understand your anger but the blame is soley on the owners of the company.

Hopefully we will get our stuff,,,,

I purchased furniture from Penthouse Furniture in Calgary on Blackfoot Trail. I was suppose to get delivery on Dec 13, 08, after waiting for whole day i tried calling them to get Store is permanently closed and the phone number they gave me for delivery wont work either. I spent $3500 for stuff which i am not getting now, as they say store has gone bankrupt.

They already knew what was going on with the store, as stores dont go bankrupt over night, but they still kept on selling products to us, so that in the end they can run with our hard earned money.
If any of you are in the same situation with Penthouse or any other store run by them, lets get together to see what we can do to get our stuff or money back.

That's a horrible situation to be in, especially right before Christmas, hopefully you guys paid by credit card and can ask your credit card company to do a chargeback

I can't understand how these liars and thieves get away with this. They have almost $4,000 dollars of my hard earned money and I have nothing to account for this. What a Christmas they've given me and my family. We have no furniture..no monsy but no doubt they will be taking their antire families on warm weather vacations this Xmas ...or is it Happy HanakaH for them all! ...pardon my disgust.

I need HELP! I have purchased furniture from Penhouse approx 25,000.00 worth of furniture. I was supposed to receive delivery of it today and they didn't show up. I was pushed to hear from Nordesign an emplolyee there that they are bankrupt and the bank has re-possessed the establishment. I have paid for items there and are many more clients that have also paid for their products that have not been received. We purchased an upscale living room suite from penthouse Furniture in Winnipeg; We loaded and picked up the pieces immediately; as the store was going out of business. I understand that many people are out their furnishings and their money due to the companies bankruptcy proceedings. I feel sorry for these people; Buyer Beware; if you purchase something ALWAYS take it home with you; I have learned that the delivery and the warranties companies sell have been questionable! I hope that these people find some kind of recourse and are reimbursed. Our furnishings look absolutely fabulous and at an incredible price.

My husband and I placed an order for a custom designed couch on October 2nd. The date of delivery was tentatively set for December. In the beginning of December we received a letter from Nefco (photcopied signiture - Larry Adelman) that informed all 'loyal' customers that the furniture was still going to be delivered regardless of them closing the store.

I called the Nefco head offce, which by the way is the same phone number and address as Penthouse. I left a message and two days later a woman returned my call. She said it was the fault of Palliser that we still haven't received our couch. I called Palliser, and they said to call Nefco...

I called Nefco back and the woman said that if we come to their last weekend sale, and find something else that we like we could get 125% of our deposit back if we purchase instore. I asked what would happen to the other couch at Palliser and she said that the order could be cancelled. My husband and I went to Penthouse but I truly think that they marked the prices up and then down a little. Several couches were in the $20,000.00 - $17,000.00 margin. We walked out with nothing.

Now the Winnipeg Free Press is informing the public that customers are having trouble with their deliveries.

I called Nefco but of course, the message is dated. Saying that the store is closed for their 'big' sale.

Lastly, I called the head office at Palliser. I spoke with Sherri and she said they don't know if our couch is in production or not. They won't know which is ours until production is finished. This made no sence to me at all! They must have our name on record and what particulars we want done to the couch. She said they don't have our deposit either.

I'm not sure who's to blame, or where to turn. I guess I'll just have to keep reading the Winnipeg Free Press. They're the only ones that seem to be on top of things:-)

Not sure if this is the right forum to vent...but does anyone know what is happening with furniture deleveries from the Sargent warehouse?? I bought a sectional 8 weeks ago, before the going out of business sale. They told me they would hold it there for me until I was ready for it in my new house. Now I am ready but can't get anyone to return my call. Rumour is they are closed for good but how do I get my funiture??? Help.

Avoid this company at all costs. Immediately upon accepting our deposit of $2,100.00 on August 29, 2008, our sales rep (Lin Stradecke) became secretive and uncommunicative. She has not returned any of 6 messages left for her, and when confronted face-to-face in the store, she excused herself and disappeared. Furniture has not been delivered and it appears company is now going broke. Doubt they ever even ordered it. We have commenced civil proceedings with our lawyer (naming both the company and the sales rep) and the lawyer advises this will likely also lead to criminal charges for fraud. DO NOT buy from this group of companies--they are soon closing their doors, and any deposits will just disappear.
