Last year my son had a serious accident with my car and was charged with impaired driving as he failed a breathalyser test. I have always assumed that a failed breathalyser test means an automatic conviction. We contacted Mike Kruse and determined that we had options and that the case was worth fighting. Throughout the process, Mike and his team worked extremely hard in preparing our case; including the recruitment of an expert witness and a full analysis of the accident scene. In addition, Mike and his staff did their best to reduce our stress with honest assessments of the crown’s case and the likelihood of a successful challenge to the charges. We met with Mike in our home, at the accident scene, at his office and at court. Mike prepared and submitted a Charter challenge regarding the breathalyser procedures. On the day of the trial, the Crown attorney offered to reduce the charge from Impaired Driving to Careless Driving. We accepted the offer since the Careless charge is a Highway Traffic offence and not a criminal charge which would have left my son with a criminal record. Mike and his team worked extremely hard and Justice L. noted in his closing remarks that Mike’s preparation and the Charter Challenge submission was very thorough and well presented. We were very pleased with the work done on our behalf and would recommend Kruse Law if you are facing similar charges.
